Terms of Use

MarketEd is an app made by Flaronix ("we" or "us"). Please read these terms. By creating an account or using MarketEd you agree to them.

Agreeing to these terms

By creating an account or using MarketEd ("the app"), you agree to these Terms of Use and to our Privacy Policy. You must be at least 13 years old to use MarketEd. If you are under 18, you confirm that a parent or guardian has agreed to these terms for you. If you don't agree, please don't use the app.

What MarketEd is

MarketEd is a game for learning how markets work. You trade and compete with mock money only. No real trades are placed, and no real money is ever deposited, withdrawn, or wagered. The full statements are in the MarketEd app, under Profile → Legal & disclosures.

Your account

Give accurate information when you sign up and keep your password private. You are responsible for what happens under your account. Choose a username that isn't offensive or misleading and doesn't pretend to be someone else, because other players can see it. You can delete your account at any time in the MarketEd app, under Profile.

Mock money

Your balance, monthly credits, and any in-game rewards are virtual currency that exists only inside MarketEd. It has no cash value and can never be withdrawn, exchanged, redeemed, sold, or transferred for real money or prizes.

Unused virtual currency does not expire. Monthly credits are added to your balance and never reset, and if a paid plan ends, the currency you already received stays in your balance. Deleting your account does remove everything in it, including its balance.

Paid plans

MarketEd is free to download, and your Portfolio and practice drafts are free. The games (Fantasy League, The Trading Cup and Bottom Call) come with a limited number of free tries. In Fantasy League and The Trading Cup, a try is used up when a game you are in finishes, and the two share 2 free tries. Bottom Call has its own 2 free days: a day is used up as soon as you make a guess on it, and you can still change a guess on a day you have already entered. Once your free tries are used up, joining a new game, or guessing on a new Bottom Call day, needs a paid plan. Every paid plan (Plus, Pro and Elite) includes every game, and also adds more monthly virtual currency and features. Games you have already joined keep going if your free tries run out or your plan ends. If you buy a plan, the price, length, and renewal terms are shown before you confirm. Apple or Google handles the purchase under their own terms, and the plan renews automatically until you cancel it in your device's subscription settings. Deleting your MarketEd account does not cancel a subscription. Refunds are handled by Apple or Google.

If a plan ends and your new plan can't trade something you already own, those holdings are frozen, not sold: you can still see them, but you can't trade them until you subscribe to a plan that covers them.

Leagues and competitions

Leagues, drafts, and tournaments have no real prizes, and you get a limited number of free tries before a paid plan is needed (see Paid plans). Rewards are virtual and follow the mock money rules above. The person who creates a league manages it within the options the app gives them, including choosing the Monday its season starts. A private league that hasn't drafted by 11:59 PM Eastern on the Sunday before its start Monday is drafted automatically: every team is picked for instantly (a person's saved queue first), and if the host chose to, empty seats are filled with computer teams. We may end, reset, or remove a league or a result if there is a bug, cheating, or abuse.

Bottom Call and Clout

Bottom Call is a daily guessing game with no entry fee and no real prizes. You guess the lowest price a stock, an ETF and a coin will reach on the next day, one guess for each. You can save and change your guess until midnight New York time, when that day starts, and then it is locked. The closest guesses earn Clout. Clout is a virtual score with no cash value: it can't be bought, sold, spent, withdrawn, or exchanged for money or prizes, and it never mixes with your Portfolio balance. Prices shown in the app are delayed and approximate. Stock and ETF results are worked out from the official end-of-day prices our data provider publishes after midnight New York time, and coin results from the prices we recorded that day. If a price is missing, wrong, or late, we may delay, correct, or cancel a round and the Clout paid for it. Once a round is settled, the usernames and guesses of the closest players are shown to all players. Bottom Call has its own number of free tries (see Paid plans).

Computer teams

To keep leagues full (for example, when too few people sign up for a public weekend draft, when not enough other people join a Play now league before its countdown ends, or when the host of a private league chooses to fill its empty seats), some teams may be run by the computer instead of a person. A computer team is always marked "CPU" wherever it appears, is shown with a character name and avatar, drafts and plays automatically by set rules, and never chats. It is not a person, and its picks are not investment advice. A win over a computer team counts the same as any other win, including for virtual rewards. You can also run practice drafts against computer teams at any time; a practice draft has no season, no rewards and no chat, and it is deleted when you finish it.

League chat

Each league has a chat for talking about the draft. Keep it friendly and on topic. Don't share links, email addresses, or phone numbers, and don't harass, threaten, or discriminate against anyone. Some messages are blocked automatically, and messages can be slowed down if they come too fast.

Any player can report a message or block a player by tapping the message in the app's chat. Blocking is private: the other player isn't told. We review reports, aim to act on them within 24 hours, and may remove messages or suspend or remove accounts.

Public leagues include players you don't know, so they have stricter rules: more words are filtered, messages send a little slower, and a few unsure messages are held for review before other players can see them. If several different players report you in public leagues, you may be muted there for 24 hours (you can still read). In public leagues you can also turn chat off for yourself.

Fair play and respect

Don't cheat, use bots or scripts, exploit bugs, open extra accounts to gain an unfair advantage, harass other players, post unlawful or offensive content (including in usernames and league names), or try to break, probe, or overload the app or its servers. We may warn, suspend, or remove accounts that do.

Not investment advice

Nothing in MarketEd is investment, financial, legal, or tax advice, and MarketEd is not a broker, an exchange, or an investment adviser. Market information is delayed, may contain errors, and is for education and entertainment only. Doing well in the game doesn't predict real-world results, so please don't base real-money decisions on it.

Other companies' names and data

MarketEd shows the names, tickers, and prices of companies, funds, and cryptocurrencies that belong to other people. MarketEd is not affiliated with, endorsed by, or sponsored by them. Apple and Google are not sponsors of, and are not involved in, any competition in this app. All other names and trademarks belong to their owners.

Ending your use

You can stop using MarketEd and delete your account whenever you like. We can suspend or end your access if you break these terms or misuse the app, or if we discontinue the app or a feature. If we stop the whole service, we'll tell you where we reasonably can.

Warranty and liability

MarketEd is provided "as is" and "as available." We don't promise that it will always work, be free of errors, or be uninterrupted. Because MarketEd uses mock money only, you can't lose real money by playing. To the fullest extent the law allows, MarketEd and its owner are not liable for indirect or consequential losses, or for losses beyond what you paid us in the 12 months before the problem. Some places don't allow these limits, so they may not fully apply to you.

Changes to these terms

We may update these terms as MarketEd grows. When we make an important change, we'll tell you in the app before it applies. If you keep using MarketEd after a change takes effect, you accept the new terms.

Governing law

These terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law rules. Disputes will be handled in the courts there, unless the law where you live gives you the right to bring them somewhere else.
